Please review these Terms of Service very carefully.  By purchasing our products and/or services, you are agreeing to these and are expressing that you have been given reasonable access to review these terms prior to your purchase. These Terms are binding as of the date you purchase or access our products and/or services.

1.   DURATION OF SERVICES

It is understood and accepted by the client (you) that:

A.  The service begins on the date the provider (American Career Horizons LLC) receives the complete amount charged for the chosen service or the first installment in case of multiple payments.

B.  The service is maintained throughout the processing of the client's file by the organizations concerned as part of the process (nursing schools, licensing authorities, boards of nursing, assessment agencies, etc.). The client understands that their file processing time is strictly inherent to each institution and independent of the provider, who cannot be held responsible in the event of any delay.

C.  The service officially ends when the client obtains their ATT.

D.  The service ends automatically if the client is not considered eligible by the organization responsible for evaluating their file. The result of the evaluation of the file is strictly inherent to each institution and independent of the provider. The client understands that the provider will not be held responsible and no refund will be issued in the event of an unfavorable result. 

 

E.  The client understands and agrees that all service payments made to the provider are not refundable. In the case of the client wishing to cancel the service, the provider will not be mandated to refund any payment already charged to the client. 

 

 

2.  INTERRUPTION OF SERVICES

It is understood and accepted by the client that:

A.  The following elements constitute grounds for definitive termination of the service by American Career Horizons LLC and without the possibility of refund:

- Failure of the client to provide within six months, from the date on which the contract was signed, the elements necessary for the provider to perform the service (The provider ensures to return all the original documents provided by the customer within a reasonable time upon completion of the service).

- Failure of the client to take the necessary academic exams, such as IELTS, TOEFL, NCLEX, CGFNS Certification Exam, within one year from the first day of the service.

- Failure of the client to pay the monthly payments in the case of multiple installments.. Fees for reopening the file may be charged after this time.

Customer's failure to comply with American Career Horizons' confidentiality requirements set forth in the Non-Disclosure Policy.

B.  The following are grounds for temporary suspension of service by American Career Horizons LLC:

- Failure to receive the monthly payment, in the case of multiple installments.

 

 

3.  SERVICES LIMITATIONS

It is understood and accepted by the customer that:

A.  American Career Horizons LLC disclaims all liability for the following, which in fact does not constitute grounds for reimbursement of payments made by the client for the service:

- Client's failure to pass mandatory exams, such as IELTS, TOEFL, NCLEX, CGFNS Certification Exam, etc...

- Failure of the client to provide, deliberately or not, accurate and/or complete information leading to legal proceedings, disciplinary measures and rejection of the file without the possibility of re-applying.

B.  By providing the service under these terms, it is expressly agreed that the provider is acting as an independent and non-employee contractor. The service provider and the client acknowledge that this agreement does not create a partnership or joint venture between them and constitutes exclusively a contract for services.

 

 

4. SERVICES EXTENDED FEES

It is understood and accepted by the client that:

A.  The amount invoiced by the provider does not include costs related to other organizations, such as academic examination services (ETS, Pearson VUE, etc.), credential evaluation agencies, translators, academic authorities (boards of nursing, etc.), etc.

B.  The amount invoiced by the provider does not include the cost of postal services above $40.

 

 

5.  NON DISCLOSURE POLICY

A.  The client acknowledge that all information and documents that they may have knowledge of or access to through their collaboration with American Career Horizons LLC are strictly confidential 

B.  The client agrees at all times, including once the service comes to an end, to treat as confidential all information acquired by American Career Horizons LLC, and not to disclose it. The client acknowledges that such information is not to be altered, copied in any way, or interfered with. 
The client will not discuss such information with any party, nor will he/she participate in or permit the release, publication or disclosure of such information, nor will he/she copy, photograph, scan, email, distribute, or disseminate such information.

C.  The client understands that compliance with the confidentiality requirements of American Career Horizons LLC is a condition of the validity of this agreement and that failure to comply with the policy may result in termination of all services by American Career Horizons LLC without any possible refund. The breaching of this non-disclosure policy is considered as misappropriation and may be subject to judiciary pursuit.
The client understands that even if the service and its terms have ended, he/she retains its obligations under intellectual property laws.
